I went to court two weeks ago for my subaru. Found out half the reason was for my "unauthorized equiptment" due to the exhaust. Found out the other half was for my "huge illegal whale tail wing!" In other words, he told me the factory sti wing is illegal and half the reason I got pulled over. Fucking cops. And in court, I find out he is a detective! Since when did were 3" exhausts categorized in a detective's line of work?

lol You can get a ticket for the factory wing on an STI?? Thats gayy, cops should be going after the bad stuff that go on out in the world, not nice clean cars that sound nice or have a wing, it annoys me that they would do that ahah and thats fucking weird that a detective would be the one working on catching people for something on ther car ahah
you still have to pay like 70 bucks for court fees....id rather just pay the 90 and not wake up to spend half a day in court...thats just me tho

Bring the STI sales brochure and tell the judge that the wing is original equipment that meets USDOT requirements. That should be the end of that debate.

The exhaust you just have to fix. Anything except OEM is illegal in VA.

You don't if they dismiss the case, which has been the case everytime I've been to court for car related stuff
and ken, I could have done that but the officer never told me that was what he was giving me the ticket for so I had no defense!
"OEM Aftermarket"

Thats what I tell them when they ask.

NISMO
TRD
MUGEN(or whatever honda's aftermarket name is)

You are required to be given notice of charges to prepare your case. If the prosecution presents new charges without giving you enough notice, you should ask for a continuation. The judge should grant it.

This is the statute they usually use to cite you: http://leg1.state.va.us/cgi-bin/legp504....+46.2-1049

http://leg1.state.va.us/cgi-bin/legp504....+46.2-1049 Wrote:"No person shall drive and no owner of a vehicle shall permit or allow the operation of any such vehicle on a highway unless it is equipped with an exhaust system in good working order and in constant operation to prevent excessive or unusual levels of noise; provided however, that for motor vehicles, such exhaust system shall be of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment. An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make.

The term "exhaust system," as used in this section, means all the parts of a vehicle through which the exhaust passes after leaving the engine block, including mufflers and other sound dissipative devices.

Chambered pipes are not an effective muffling device to prevent excessive or unusual noise, and any vehicle equipped with chambered pipes shall be deemed in violation of this section.

The law requires that your exhaust be OEM or "comparable" to OEM. Nobody knows what the hell "comparable" means. When in doubt, they'll give you a citation hoping that you are too ignorant and/or unmotivated to fight it.

The proper way to test the exhaust is to measure sound level and compare with the stock exhaust. There is no guideline for this measurement so ultimately it comes down to the officer's discretion and the judge.

I really hate this law because it's really vague and ignorant police officers have given tickets for stock exhaust.

Don't let ignorant people push you around. Educate yourself and defend yourself adequately.
